A BILL to amend and reenact section thirteen, article ten, chapter
eighteen-b of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to providing that a
governing board of a state institution of higher education may
not require a student to reside in a dormitory at that
institution
if the student has completed thirty or more credit
hours of course work from any accredited college or
university; prohibiting a governing board from requiring
dormitory students at that institution to purchase cafeteria
meal plan; and requiring a governing board to provide meal
plan options at that institutions's cafeterias.
Be it enacted by the Legislature of West Virginia:

That section thirteen, article ten, chapter eighteen-b of the
code of West Virginia, one thousand nine hundred thirty-one, as
amended, be amended and reenacted to read as follows:
ARTICLE 10. FEES AND OTHER MONEY COLLECTED AT STATE INSTITUTIONS

OF HIGHER EDUCATION.
§18B-10-13. Fees from operation of dormitories, faculty homes,
dining halls and cafeterias.

(a) The appropriate governing board of each state institution
of higher education shall fix the fees to be charged students and
faculty members for rooms, board and meals at the dormitories,
faculty homes, dining halls and cafeterias operated by such board
at the institution. Such fees shall be commensurate with the
complete cost of such services.

All fees collected for such services shall be used first to
pay the operating and maintenance costs of the dormitories, faculty
homes, dining halls and cafeterias and to meet interest, principal
and sinking fund requirements due on any outstanding revenue bonds
for which such receipts may have been pledged as security. Any
such receipts not needed for these purposes may be expended by the
appropriate governing board to defray the costs in whole or in part
for the construction of any such facility.

(b) No governing board of a state institution of higher
education may require a student to reside in a dormitory at that
institution
if the student has completed thirty or more credit
hours of course work from any accredited college or university.

(c) No governing board of a state institution of higher
education may require a student residing in a dormitory at that
institution to purchase meals from a dining hall or cafeteria in the dormitory or from any other food service facility operated by
the institution. The governing board shall make available to
students residing in dormitories at that institution a selection of
meal plan options from its dining halls or cafeterias, which shall
include:

(1) A "full meal" plan option providing a minimum of nineteen
meals a week;

(2) A "no purchase" plan option providing students the choice
of not participating in the dining hall or cafeteria meal plan; and

(3) At least one "limited meal" plan option providing
students a reasonable alternative between the "full meal" plan
option and the "no purchase" plan option.

NOTE: The purpose of this bill is to
provide that a state
college or university
may not require a student to reside in a
dormitory at that institution
if the student has completed thirty
or more credit hours of course work from any accredited college or
university. The bill also prohibits a state college or university
from requiring dormitory students at that institution to purchase
a cafeteria meal plan, and requires the college or university to
provide certain cafeteria meal plan options available to students.
